Setting up Practice

Do we need to get approval for setting up a new practice?
A
:
Yes. You need to get the approval of the Bar Council for the use of the firm’s name.
 
Q
:
Do we need to inform the KLBC when we set up a new practice? What kind of information do we need to provide?
A
:
Yes, if the Practice is in Kuala Lumpur and after receiving approval from the Bar Council. You will have to furnish the date of commencement of the Practice, address, telephone and facsimile numbers, e-mail address, if any and a copy of the letter of approval from the Bar Council. You will also have to provide the names of all the partners (whether they are based in KL or another State if there are branch offices) and legal assistants (those based in the KL office only).

Yes so long as they have already been called to the Malaysian Bar and have known you for more than 5 years.

Where do I register for the compulsory 14 days Legal Aid Service?

:
At the Bar Council Legal Aid Centre (Kuala Lumpur) located at the following address: 6th Floor, Wisma Kraftangan, No. 9 Jalan Tun Perak, 50050 Kuala Lumpur.

Can a foreigner apply for admission as an Advocate & Solicitor of the High Court of Malaya?

:
No unless he/she has Permanent Resident (PR) status.

How do I know if my LL.B Degree or the University where I am pursuing my LL.B Degree is recognised?
A
:
Check with the Legal Profession Qualifying Board, Malaysia [Board] which is located at 27th Floor, Menara Tun Razak, Jalan Raja Laut, 50350 Kuala Lumpur (Tel: 03-26910054/80 and Fax: 03-26910142). In fact any queries pertaining to qualifications that may entitle a person to become a qualified person for the purposes of the Legal Profession Act should be directed to the Board.

Where do I apply for the BC Boxes and what are the charges like?

KL Bar Secretariat. Deposit of RM50.00 per box (one-off payment but refundable upon return of the box and not in breach of any of the terms and conditions) and Rental of RM50.00 per box per year.

Where and how do I report if my BC Box or its lock is spoilt?
A
:
Fax a note on your firm’s letterhead to the KL Bar Secretariat (Fax: 26911090) and specify the BC Box number, its location and the problem (eg jammed lock, box cover is loose etc)

What should I do if I have lost the key(s) to my BC Boxes?
A
:
You may apply for duplicate keys at RM2.00 each from the KL Bar Secretariat. Fax a note on your firm’s letterhead to the KL Bar Secretariat (Fax: 26911090) and specify the BC Box number and its location. You may pay in advance or at the time of collection of the duplicate key(s).

Can I request for the change of the lock to my BC Boxes? If yes, how do I go about it?
A
:
Yes you can but the charges would have to be borne by you. Fax your request on your firm’s letterhead to the KL Bar Secretariat (Fax: 26911090) specifying the BC Box number and its location with an undertaking to pay the necessary charges (approx. between RM45.00 and RM50.00 per lock).

How do I place a Vacancy Notice on all the KLBC notice boards and what are the charges?
A
:
Type out the Notice adhering to the “Website Vacancy Notice” format and in A5 (landscape) size (ie half A4). E-mail (rajan@klbar.org.my) or fax the notice to the KL Bar Secretariat (Fax: 26911090) with a request to place it on the KL Bar’s notice boards. There is no charge.
