Areas to be covered
With the increase in global business transactions and the mobility of persons across national boundaries, the need for an effective method to enable a civil judgment given in one country to be enforced in another country is becoming more important. The increase in cross-border litigation and business efficacy demands predictability in enforcement of claims against their debtors in foreign countries.
The talk will cover areas including:
• the mechanisms for recognition and enforcement of foreign judgments
• an outline of the Reciprocal Enforcement of Judgment Act 1958 (“REJA”)
• issues in recognizing and enforcing foreign judgments
• recent developments
